1. Acceptance of Terms
By accessing or using Voiv.io (the “Site”), you agree to comply with and be bound by these Terms of Use, our Privacy Policy, and any other legal notices, conditions, or guidelines located on the Site. If you do not agree with these terms, you should not use or access the Site.
2. Use of the Site
You may use the Site for lawful purposes only. You agree not to use the Site in any manner that could damage, disable, or impair any of our services or interfere with any other party’s use of the Site. You may not attempt to gain unauthorized access to any part of the Site, other users’ accounts, or any system or network connected to the Site.
3. User Accounts and Registration
To access certain features of the Site, including purchasing NFTs and cultural artifacts, you may be required to register for an account. By creating an account, you agree to provide accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your account information, including your password. Voiv.io is not liable for any loss or damage arising from your failure to protect your account information.
4. Purchasing and Ownership of NFTs
The Site allows users to purchase non-fungible tokens (NFTs) representing ownership of specific digital assets, including but not limited to digital representations of cultural artifacts. Upon purchasing an NFT, you receive full ownership of the token, but not any intellectual property or rights to the underlying cultural artifact or any associated content unless explicitly stated.
By using the Site to purchase NFTs, you acknowledge and agree that:
- All sales are final. Once you purchase an NFT or digital collectible, it cannot be returned, refunded, or exchanged (refer to our Refund Policy for details).
- The ownership of the NFT is transferred to you once the transaction is completed, but any intellectual property related to the digital asset may remain the property of Voiv.io or the respective content creator or museum partner.
5. Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
- Using the Site to violate any applicable law or regulation.
- Attempting to probe, scan, or test the vulnerability of any system or network connected to the Site.
- Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
- Uploading, transmitting, or distributing any material that contains software viruses or any other harmful code.
- Engaging in any form of automated access or use of the Site (such as using bots or crawlers) without our prior written consent.
6. Termination of Use
Voiv.io reserves the right, in its sole discretion, to terminate or suspend your access to the Site, without prior notice or liability, for any reason, including violation of these Terms of Use.
7. Intellectual Property
All content on the Site, including text, images, graphics, logos, and software, is the intellectual property of Voiv.io or its licensors and is protected by international copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any part of the Site without prior written consent from Voiv.io.
8. Limitation of Liability
In no event shall Voiv.io, its affiliates, or their respective directors, employees, or agents be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site, NFTs, or digital artifacts purchased from the Site, even if Voiv.io has been advised of the possibility of such damages.
9. Changes to Terms
Voiv.io reserves the right to update or modify these Terms of Use at any time without prior notice. Your continued use of the Site after any changes or modifications to these terms will constitute your acceptance of such changes or modifications.
10. Governing Law
These Terms of Use are governed by and construed in accordance with the laws of the United States and any disputes arising from these terms will be resolved in the appropriate jurisdiction.
